1. Identification of the parties

These terms of use govern access to and use of the NIAR website and app, whose owner and contracting party is Pholidota Studio SL, Tax ID (NIF) B06956163, with registered office at Calle de la Diligencia 9, 28018 Madrid (Spain), hereinafter "Pholidota Studio SL". "NIAR" is a trademark of Pholidota Studio SL and not a legal entity.

2. Purpose

NIAR is a data layer for physical commerce: based on the user's location and query, it shows in which nearby shops a product can be found. NIAR is not a party to sales between users and shops and does not process payments.

3. Acceptance

Accessing and using NIAR confers the status of user and implies full acceptance of these terms, the Legal notice and the Privacy policy. If you do not agree, you must refrain from using the service.

4. User accounts

Some features require creating an account. You undertake to provide accurate information and to keep your credentials confidential. You are responsible for activity carried out from your account. You may request account closure at any time.

5. Acceptable use

You undertake to use NIAR in accordance with the law, these terms and good faith. The following is prohibited, without limitation: using the service for unlawful purposes; mass automated data extraction without authorisation; attempting to damage, overload or alter the operation of the site; or infringing the rights of third parties or of Pholidota Studio SL.

6. Third-party content and information

Information about shops, products, prices and availability may come from third parties or public sources. Pholidota Studio SL strives to keep it accurate and up to date but does not guarantee its accuracy, completeness or currency. We recommend confirming availability and price directly with the shop before travelling.

7. Intellectual and industrial property

All intellectual and industrial property rights over NIAR and its contents belong to Pholidota Studio SL, as set out in the Legal notice.

8. Limitation of liability

To the extent permitted by law, Pholidota Studio SL shall not be liable for damages arising from the use of, or inability to use, the service, nor for decisions made based on the information displayed. This limitation does not affect the rights mandatorily granted to consumers by consumer protection rules.

9. Changes and availability

Pholidota Studio SL may modify these terms and the service, and may suspend or discontinue it, at any time. The current version will be published on this page with its update date.

10. Governing law and jurisdiction

These terms are governed by Spanish law. For any dispute, the parties submit to the Courts and Tribunals of Madrid, without prejudice to the mandatory jurisdiction applicable to consumers.
